Areas of Practice

Letter Before Action (LBA)

This is always step 1 in the Debt Recovery process. A legal requirement and all courts expect the claimant to have sent this letter before action to try and solve the matter and give the debtor a final chance to pay, before we proceed to a county court claim. This usually happens 14 days prior to the date of intended action taking place.

County Court Claims

This is the second stage once we have exhausted contact with the debtor and they are still refusing to pay, or get no response from them at all. We complete all paperwork and communication with the county court. This also includes necessary paperwork, should a defence be raised and we can even attend the court proceedings on your behalf.

High Court Enforcement

Should the county court claim be successful, and we have received the judgement order from the court, we can then begin the ‘transfer up’ procedure to obtain a High Court Writ of Control. This will be signed off from one of our partners High Court Enforcement Officers (HCEO) and on obtaining this writ, one of our Enforcement Agents will visit the debtors address in order to ‘Take Control of Goods’ and prepare them for removal, unless the full balance is paid in full. Depending on each individual situation there are other services we offer including Debtor Tracing, HPI Vehicle Checks and DVLA Vehicle Checks. If a decision is made to remove goods or vehicles, we may ask for an indemnity until the sale takes place.

Commercial Rent Arrears (CRAR)

Under Commercial Rent Arrears Recovery (CRAR) if the commercial rent is 7 days overdue you can instruct us to get your money back, by visiting the premises and remove goods to sell if they don’t pay.
